HAMM INSURANCE PLAN: REALITY SETS IN

Halifax - Nova Scotia NDP Leader Darrell Dexter is calling for the withdrawal of the 2003 amendments to the Insurance Act that are compounding the harm done to victims of motor vehicle accidents.

Dexter says the province is now beginning to see the real impact of the Hamm Conservatives’ changes to insurance legislation after hearing about one family’s struggle to be treated fairly by their insurer.

“When the Hamm government permanently traded away the rights of citizens for a temporary reprieve on insurance premiums, you could see this day coming,” said Dexter. “This is precisely why the NDP voted against Bill 1.”

Dexter has written the Minister responsible for Insurance, Ron Russell, on behalf of an Annapolis Valley family who has been fighting a major insurance company since the family’s 72-year old mother was struck by a car at a sidewalk crossing in New Minas in June 2004.

“Insurers have resources that dwarf those of victims. They have the money to hire the best experts in medicine and law, but perhaps most importantly, they have the power to say no.”

“Thanks to Bill 1, victims now have no recourse unless they happen to be wealthy enough to go head to head with these large insurance companies. Prior to this, victims would be able to find lawyers to take their cases on a contingency basis. They would have someone to stand up for them and make sure that the insurer was living up to their obligations under the policy.”
